Agreement

These terms apply to your use of tarmicdigital.com, including the client portal. By using the site you agree to them. If you don't agree, please don't use the site. “Tarmic”, “we” and “us” mean Tarmic Digital Solutions of Las Vegas, Nevada.

Our services

Website design, website management, Website as a Service and related work are provided under a separate proposal, quote or service agreement. That document sets the scope, price, timeline and payment terms, and it takes priority over these terms if they conflict.

Information on this site about services, timelines and response times describes how we normally work. It isn't a binding offer until we've agreed the work with you in writing.

Client accounts

• Give accurate information and keep it up to date.
• Keep your password private. You're responsible for activity under your account, so tell us straight away if you think someone else has used it.
• Requests sent through the portal are handled under your service agreement. Urgent requests are prioritised but aren't a guaranteed emergency response unless your agreement says so.
• We may suspend or close an account that's misused, that puts the site's security at risk, or that has seriously overdue invoices, after trying to contact you first where reasonable.

Invoices and payments

Invoices shown in your portal are payable by the due date shown. Payments are processed by third-party providers (such as Stripe or PayPal) on their own secure pages, under their terms. We don't store your card or bank details. Late payment, refunds and cancellation are covered by your service agreement.

Buying a domain

• Domain listings on this site are invitations to make an offer, not offers to sell. Prices and availability can change without notice.
• A sale is final only once we've both agreed the price in writing and payment has cleared.
• Transfer times are estimates and depend on registrars.
• Sample websites built on listed domains show what's possible. Their content isn't included in a domain sale unless agreed in writing.
• You're responsible for making sure your use of a domain doesn't infringe anyone's trademark or rights.

Your content

You keep ownership of the logos, photos, text and files you send us. You give us permission to use them to provide the services you've asked for. When you upload or send material, you confirm you have the right to use it and that it doesn't break any law or infringe anyone's rights.

Our content

The design, text, graphics, logo and code of this site belong to Tarmic Digital Solutions or its licensors. You may view and share pages for personal or business reference, but not copy, resell or republish the site or its design without permission. Ownership of websites we build for clients is set out in each service agreement.

Acceptable use

Don't use the site to break the law, send spam or malicious code, try to get into accounts or systems that aren't yours, overload or scrape the site, or upload anything unlawful, abusive or that infringes someone else's rights.

Other websites

We link to sites we don't control, including domain listing and payment pages. We're not responsible for their content or practices. Our assistance with GoDaddy accounts is independent; Tarmic isn't affiliated with GoDaddy.

Disclaimers

The site is provided “as is” and “as available”. We work to keep it accurate, secure and online, but we don't promise it will always be error-free or uninterrupted. Nothing here is legal, financial or tax advice.

Limitation of liability

To the extent the law allows, Tarmic isn't liable for indirect, incidental or consequential losses, such as lost profits or data, arising from your use of this site. Our total liability relating to the site is limited to $100, or, for paid services, to what your service agreement provides. Some places don't allow these limits, so they may not all apply to you.

Governing law

These terms are governed by the laws of the State of Nevada. Any dispute will be handled in the state or federal courts located in Clark County, Nevada, unless your service agreement says otherwise.

Changes

We may update these terms and will change the date at the top when we do. Continuing to use the site after a change means you accept the updated terms.
